1. Acceptance of Terms
 
These Terms of Use (“Terms”) govern your access to and use of the Heritage Management website, including all pages, features, content, and the online parking subscription service (collectively, the “Site”).
 
By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, you must not use the Site.
These Terms govern use of the Site only.
 
The purchase and use of parking subscriptions and physical parking facilities are governed separately by the Parking Terms & Conditions.
 
2. Use of the Website
 
You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:
 
  • Violate any applicable laws or regulations;
  • Attempt unauthorized access to systems or accounts;
  • Interfere with Site functionality or security;
  • Introduce malicious code or harmful software;
  • Use automated tools (bots, scraping) without permission;
  • Misrepresent your identity or affiliation.
  • We reserve the right to suspend or terminate access for violations.

 

3. General Website Content
 
All content on this Site is the property of Heritage Management or its licensors and is protected by applicable intellectual property laws.
 
Content may not be reproduced, distributed, or modified without prior written consent.
 
Information on the Site is provided for general purposes and may be updated without notice.
 
4. Parking Portal and Reservations
 
The Site allows users to select and reserve parking spaces.
 
Submission of a reservation request:
 
  • Does not constitute a completed purchase;
  • Temporarily holds the selected parking space pending payment;
  • May be subject to time limits or cancellation if payment is not received.
 
Heritage Management reserves the right to release any reservation where payment is not completed within the specified timeframe.
 
5. Payment Process
 

Following a reservation:

  • Payment instructions will be provided separately, including via secure payment link or in-person payment;
  • A reservation is not confirmed until full payment is received and processed;
  • Pricing and applicable terms are disclosed at the time of reservation.
 
By completing payment, you confirm that:
 
  • You are authorized to use the selected payment method;
  • You agree to the applicable Parking Terms & Conditions.
 
6. Subscription Purchases and Billing
 
Parking passes are sold as monthly subscriptions and are subject to the Parking Terms & Conditions.
 
By completing payment, you:
 
  • Authorize recurring billing where applicable;
  • Acknowledge that billing will continue until cancelled in accordance with the Parking Terms & Conditions.
 
7. Payment Processing
 
Payments are processed by Albert Management on behalf of Heritage Management through secure third-party payment processors (including Elavon).
 
Heritage Management or Albert Management does not collect or store credit card information on its servers. All payment data is transmitted directly to the payment processor.
 
Heritage Management and Albert Management are not responsible for errors, service interruptions, or security incidents related to third-party payment systems.
 
8. Website Availability and Accuracy
 
We make reasonable efforts to maintain the accuracy and availability of the Site but do not guarantee:
 
  • Continuous or uninterrupted access;
  • That the Site will be error-free;
  • That all information is current or complete.
 
We are not liable for service interruptions, technical issues, or events beyond our control.
 
9. Third-Party Links
 
The Site may contain links to third-party websites. We are not responsible for their content or practices.
 
10. Limitation of Liability
 
To the maximum extent permitted by law, Heritage Management is not liable for indirect, incidental, or consequential damages arising from:
 
  • Use or inability to use the Site;
  • Errors or technical issues;
  • Unauthorized account access due to user actions;
  • Reliance on Site content.
 
11. Indemnification
 
You agree to indemnify and hold harmless Heritage Management and its affiliates from any claims arising from:
 
  • Your misuse of the Site;
  • Your violation of these Terms or applicable laws.
 
12. Privacy
 
Your use of the Site is governed by our Privacy Policy.
 
13. Modifications
 
We may update these Terms at any time. Continued use of the Site constitutes acceptance of any changes.
 
14. Governing Law
 
These Terms are governed by the laws of the Province of New Brunswick and the laws of Canada applicable therein.
Any disputes shall be subject to the exclusive jurisdiction of the courts of New Brunswick.
